VISIT, INSPECTION AND DELIVERY OF VEHICLES

• Mandatory online registration before the vehicle visit and inspection;
• Mandatory hand disinfection at the site entrance;
• Mandatory hand disinfection between each vehicle inspection;
• Distance of 2 meters between people;
• Wearing a mask compulsory indoors and strongly recommended outdoors;
• 50 people maximum at a time on the site;
• 4 people maximum at a time in the administrative area;
• No accompanying person authorized;
• A chemical toilet available outside (responsibility of the user to clean before and after use);
• Increased surveillance by security guards to ensure compliance with the rules;
• Telephone payment by preferred credit card before vehicle delivery.

SAFETY INSTRUCTIONS FOR INSPECTING VEHICLES
-Only people 14 years of age and over are allowed on the auction site. You must be registered for the auction before you can inspect vehicles.
-To avoid any possibility of injury, caution and vigilance are required, as vehicles may be moving.
-A valid driver's license is required to test vehicles.
-Please do not start a vehicle if you do not have the required skills (motorcycles, manual transmissions, specialized equipment, etc.).
-When testing a vehicle, you must sit in the driver's seat, with both feet in the vehicle and the doors closed.
-It is strictly forbidden to drive behind vehicles.
-For any assistance, do not hesitate to contact an agent.
-You are responsible for any material or bodily injury.

GENERAL INFORMATION

1. Anyone who wishes to register must read and agree to the terms and conditions of the auction.
2. Registration is done online only. Go to the "Auction sales" section of the disposal of goods website (www.dispositiondesbiens.gouv.qc.ca) for more details.
3. Upon registration, a deposit of $ 1000 (refundable, payable by credit card) is required. An agent will contact you by phone to proceed with the transaction. This deposit may be withheld as a penalty for non-compliance with the terms and conditions of the contract or upon cancellation of the contract.
4. The CSPQ provides in good faith the information at its disposal for each lot. The photographs and information provided are presented for illustrative purposes only and do not guarantee the condition of the goods.
5. The CSPQ cannot be held responsible for any omission or incomplete inspection of the lot by the bidder.
6. All the lots or goods awarded by the auctioneer make the sale perfect, final and irrevocable.
7. The lots are sold as is, without guarantee and at the risk and peril of the buyer.
8. Each lot becomes the responsibility of the new owner as soon as the auctioneer announces that a lot has been awarded.
9. All sales are subject to the federal goods and services tax (GST) of 5%, as well as the Quebec sales tax (QST) of 9.975%.
10. Bidders who win an auction must pay an administrative charge of 10% before taxes on each lot.
11. Lots must be paid in full and picked up within two (3) days of the end of the auction. An additional storage fee of $ 50 per item per day of delay may be charged to late arrivals as a penalty.
12. It is forbidden to resell the goods before the lot has been collected by the bidder and / or at the auction premises.
13. Mechanical work is not permitted on the auction premises.

15. The terms set out above do not constitute all of the terms and conditions of the auction. You will find the full terms and conditions on the following pages.
16. For any purchase made online, the CSPQ assumes no responsibility for possible interruptions to the Internet connection, sound cuts or the delay in retransmission of the auction.
In the event of a dispute relating to the auction, the final decision rests with the auctioneer.
Once the sale is completed, an invoice from the CSPQ will be emailed to you. This invoice is final and will confirm the lots that have been awarded to you.

TERMS AND CONDITIONS
GENERAL

The CSPQ provides in good faith the information it has for each lot. The lots are put up for sale according to the formula "as is, on site", that is to say that each property is sold as seen, at the risk of the purchaser. The photographs and information provided are presented for illustrative purposes only and do not guarantee the condition of the goods.

The goods that are the subject of this auction are sold as is, without legal warranty, at the buyer's risk and peril. Furthermore, the Consumer Protection Act does not apply when a person purchases surplus goods from the Quebec government.

The successful bidder of a lot becomes responsible for it as soon as it is awarded. As a result, the CSPQ disclaims all responsibility for any damage and loss that may occur to this property following the auction.

The CSPQ assumes no responsibility for damage or loss resulting from the handling or circulation of the vehicle, and the purchaser expressly undertakes to keep it free from any claim.

The purchaser must assume the transport costs of the goods acquired and ensure that they meet the requirements of the Highway Safety Code for their transport.

The CSPQ does not guarantee the result of the reading of the odometer indicated. The numbers shown on the odometer at the time of vehicle preparation are merely indicative.

REGISTRATION

Anyone wishing to participate in the auction must register online. Instructions can be found at www.dispositiondesbiens.gouv.qc.ca.

At the time of registration, the person will have to pay an amount of $ 1,000 (refundable, payable by credit card). This amount may be withheld as a penalty for non-compliance with the terms and conditions of the contract or upon cancellation of the contract.

BATCH INSPECTION

A catalog presenting the lots put up for auction is posted at www.dispositiondesbiens.gouv.qc.ca a few days before the auction is held. The CSPQ can make changes to the catalog being published. It is the responsibility of anyone interested to visit the website to take note of the changes.

Lot inspection is possible on the Wednesday, Thursday and Friday before the end of the auction, from 8 a.m. to 5 p.m.

The CSPQ cannot be held responsible for any omission or incomplete inspection of the lot by the bidder. Any natural or legal person who submits an offer acknowledges having inspected the lot and declares himself entirely satisfied. Anyone who inspects a lot is responsible for any damage, direct or indirect, material, bodily or intangible, accidental or intentional, due to his or her representative, his employee or any person who 'accompanied.

À défaut de verser le montant exigé suite à l’adjudication, la participation de l’enchérisseur à la suite de l’encan sera suspendu par l’encanteur.

MODE DE PAIEMENT

L'adjudicataire d'un lot devra effectuer son paiement total au plus tard à 16 h le mardi suivant la vente aux enchères en se présentant sur les lieux de l’encan durant les heures d'ouverture.
Toute vente est assujettie à la taxe fédérale sur les produits et services (TPS) de 5 %, de même qu’à la taxe de vente du Québec (TVQ) de 9,975 %. Des frais d’acquisition de 10 % seront également facturés, avant taxes, sur le montant du lot adjugé. Les frais d’acquisition sont taxables.

Les paiements téléphoniques par carte de crédit (Visa, Mastercard, American Express) sont privilégiés. Le paiement direct (Interac) ainsi que les chèques visés, mandats-poste et mandats bancaires à l’ordre de CSPQ-Gestion et disposition des biens sont également acceptés.

PRISE DE POSSESSION

L’adjudicataire devra prendre possession du ou des lots qui lui ont été adjugés au plus tard à 16h le mardi suivant la vente aux enchères. Pour ce faire, il doit se présenter sur le lieu de l’encan, pendant les heures d’ouverture.

Il doit prendre les moyens et précautions nécessaires pour assurer une prise de possession sécuritaire, et ce, en conformité avec les lois et règlements en vigueur. L’adjudicataire est également responsable de tout dommage, direct ou indirect, matériel, corporel ou incorporel, accidentel ou intentionnel qui pourrait survenir à l’occasion de la prise de possession, et ce, que ce soit du fait de l’adjudicataire lui-même, de son représentant, de son préposé ou de toute personne qui l’accompagne. De plus, celui-ci devra laisser les lieux dans un état jugé acceptable et ne sera en aucun cas autorisé à procéder à des travaux de nature mécanique sur les lieux de l’encan. L’adjudicataire ne peut procéder à la revente du lot avant d’en avoir pris possession et/ou sur les lieux de l’encan.

Des frais additionnels d’entreposage de 50 $ par article par jour de retard pourront être facturés aux retardataires à titre de pénalité.

Après le paiement, si le propriétaire d'un ou des lots n'a pas pris possession du ou des biens avant le délai indiqué précédemment, le CSPQ se réserve le droit de résoudre la vente sans aucun remboursement.

DÉFAUT DE PAIEMENT OU DE PRISE DE POSSESSSION

L’adjudicataire en défaut de paiement ou qui n’a pas pris possession du lot dans les délais prescrits est tenu de défrayer, en plus des pénalités liées à l’entreposage, la différence entre le prix de son adjudication et le prix moindre qui sera payé par le nouvel acquéreur, conformément à l’article 1765 du Code civil du Québec.

De plus, le CSPQ peut, après avoir avisé l'adjudicataire fautif, remettre le lot en vente. L’avis sera expédié, par courrier recommandé ou poste certifiée, à l’adresse paraissant au formulaire d’inscription, au moins huit jours avant la date fixée pour la remise en vente du lot.


Le CSPQ peut suspendre la possibilité de participer à ses ventes aux enchères (encans et appels d’offres), à tout adjudicataire qui ne respecte pas l’obligation d’acquitter les sommes correspondant au montant auquel le lot lui a été adjugé ou qui ne prend pas
possession du lot adjugé dans les délais convenus. En ce cas, pour participer à nouveau aux ventes aux enchères du CSPQ, l’adjudicataire suspendu doit acquitter préalablement et intégralement toutes les sommes dues au CSPQ en raison de son défaut.

Cette suspension ne dégage pas l’adjudicataire des présents termes et conditions. L’adjudicataire ne pourra tenir le CSPQ responsable de toute perte ou tout dommage direct ou indirect attribuable à cette suspension.

STATUT DES VÉHICULES À LA SAAQ ET PROCESSUS DE REMISE EN CIRCULATION

Les véhicules vendus à l’encan correspondent à l’un des statuts suivants :
?Véhicule remisé;
?Véhicule mis au rancart;
?Véhicule déclaré "perte totale".

Pour connaître les modalités entourant la remise en circulation d’un véhicule acheté à l’encan selon les différents statuts, l’acquéreur peut consulter le site de la Société de l’assurance automobile du Québec au www.saaq.gouv.qc.ca.

IMMATRICULATION

La responsabilité d’immatriculer un véhicule acheté aux enchères revient exclusivement à l’acquéreur. Pour que le véhicule acheté puisse être transféré et immatriculé à son nom, l'acquéreur doit :
?S'assurer que le ou les véhicules sont conformes aux normes de sécurité routière exigées par la SAAQ;
?Présenter l’original du contrat de vente.

PAYMENT METHOD

DEFAULT OF PAYMENT OR TAKING POSSESSION

The successful tenderer in default of payment or who has not taken possession of the lot within the prescribed deadlines is required to pay, in addition to the storage penalties, the difference between the price of his auction and the lower price that will be paid by the new purchaser, in accordance with article 1765 of the Civil Code of Quebec.

In addition, the CSPQ may, after notifying the offending purchaser, put the lot back for sale. The notice will be sent, by registered or certified mail, to the address appearing on the entry form, at least eight days before the date set for the lot to be put back on sale.

REGISTRATION
